Terms and Conditions for the VIP Day Card

1. The VIP Card is for use in Kildare Village only
2. The VIP Card must be used at the time of purchase in order to receive the price reduction
3. The VIP Card is only valid on the date of issue
4. The VIP Card is not valid in conjunction with any other promotions or offers
5. The VIP Card is valid for use by the person to whom it is issued and it not transferable
6. The VIP Card has no cash value and cannot be used for previously made purchases
7. The price reduction offered is in relation to the price of goods at an outlet store at Kildare Village, before the application of any taxes, duties, levies or similar fees.
8. The customers acknowledges and agrees that -

• Kildare Retail Services ltd. (KRS), its related companies and the owner of Kildare Village are not responsible for the prices at which an outlet store at Kildare Village advertises or sells goods from time to time;
• The VIP Card creates no contractual relationship between KRSand the customer in relation to the discount offered in the VIP Card or otherwise;
• KRS makes no warranties regarding the goods (including without limitation the quality thereof) which the customer may obtain with the VIP Cardfrom the outlet stores at Kildare Village;
• The customer shall have no right, and waives his/her ability to make any claim against KRS in the event that an outlet store at Kildare Village fails to honour the VIP Card in whole or part, and the customer's only remedy in such a situation is the make a claim for redress to the relevant outlet store; and
• Nothing in these terms and conditions shall exclude or limit KRS's liability for death or personal injury resulting from its negligence or that of its employees or officers

9. The terms and conditions of sale of an outlet store at Kildare Village shall apply to any purchases obtained from such an outlet store with the VIP Card, in addition to these terms and conditions.

10. KRS shall not be responsible or liable for any loss, damage, expense or inconvenience sufferes by the customer in respect of any goods purchased from an outlet store at Kildare Village or the refusal of an outlet store to honour the price reduction stated in the VIP Card.

11. KRS reserves the right to withdraw the VIP Card for any reason whatsoever. The VIP Card will be invalid if reproduced or tampered with in any way.

Terms and Conditions for the Private Sale event (the “Event”) being held 26 November 2009 to 29 November 2009.

1. The Event is being held between the dates of the 26 November 2009 and the 29 November 2009 inclusive (the “Period”).
2. Participation in the Event is only open to Kildare Village database members and readers of the Sunday Times.
3. The twenty percent (20) percent price reduction offered for the duration of the Event Period is in relation to the price of goods at those outlet stores at Kildare Village participating in the Event, before the application of any taxes, duties, levies or similar fees.
4. To be eligible to avail of this offer, Kildare Village database members must register at the Tourist Information Centre (“TIC”) in Kildare Village where they will be issued with a wristband (“Wristband”).
5. Customers who are Sunday Times readers must register at the Exhibition Space, located next to Pepe Jeans, in Kildare Village where they will be issued with a wristband (“Wristband”).
6. To participate in the Event and avail of the twenty (20) percent discount, customers must have a wristband issued by the TIC.
7. For the avoidance of doubt, the twenty percent discount will only be available by those stores participating in the Event.
8. On registering for the Event in the TIC, customers will also be issued with a VIP day card (“VIP Day Card”) which can be used in those outlet stores not participating in the Event and which entitles the VIP Day Card holder to a ten (10) percent reduction in those outlet stores not participating in the Event.
9. The Wristband and the VIP Day Card are not valid in conjunction with any other promotions or offers.
10. For the avoidance of any doubt, the Wristband and VIP Day Card operate independently of each other and do not operate on a cumulative basis.  The VIP Day Card qualifies the customer to avail of a ten (10) percent discount in those outlet stores not participating in the Event.
11. The Wristband and the VIP Day Card are valid for use by the person to whom it is issued and are not transferable.
12. The Wristband and the VIP Day Card have no cash value and cannot be used for previously made purchases.
13. The customers acknowledge and agree that:-

• Kildare Retail Services ltd. (“KRS”), its related companies and the owner of Kildare Village are not responsible for the prices at which an outlet store at Kildare Village advertises or sells goods from time to time;
• The Wristband and VIP Day Card create no contractual relationship between KRS and the customer in relation to the discount offered by the Wristband and/or the VIP Day Card or otherwise;
• KRS makes no warranties regarding the goods (including without limitation the quality thereof) which the customer may obtain with the Wristband and/or the VIP Gift Card from the outlet stores at Kildare Village;
• The customer shall have no right, and waives his/her ability to make any claim against KRS in the event that an outlet store at Kildare Village fails to honour the Wristband and/or the VIP Day Card in whole or part, and the customer's only remedy in such a situation is to make a claim for redress to the relevant outlet store; and
• Nothing in these terms and conditions shall exclude or limit KRS's liability for death or personal injury resulting from its negligence or that of its employees or officers

14. The terms and conditions of sale of an outlet store at Kildare Village shall apply to any purchases obtained from such an outlet store with the Wristband and/or the VIP Day Card, in addition to these terms and conditions.

15. KRS shall not be responsible or liable for any loss, damage, expense or inconvenience suffered by the customer in respect of any goods purchased from an outlet store at Kildare Village or the refusal of an outlet store to honour the price reduction stated by the participation in the Event and/or the VIP Day Card.

16. KRS reserves the right to withdraw the Wristband (and thereby the customers ability to participate in the Event) and/or the VIP Day Card for any reason whatsoever. The Wristband and/or the VIP Day Card will be invalid if reproduced or tampered with in any way.
